What is the ten-year guarantee ("garantie décennale")?
The ten-year guarantee is mandatory insurance for building trade professionals (Loi Spinetta, 1978). For 10 years after work completion, it covers damage that compromises the structural soundness of the building or makes it unfit for its intended use.
Who is required to take out a ten-year guarantee?
Any professional carrying out construction or renovation work affecting the structural elements of a building: masons, roofers, plumbers, electricians, carpenters, and more broadly any building/public works company, including sole traders (auto-entrepreneurs).
What exactly does the ten-year guarantee cover?
It covers serious damage appearing after completion of the work: structural cracks, water infiltration, roof collapse, waterproofing defects that compromise the use of the building. It does not cover minor cosmetic defects.
What does a company risk by working without a ten-year guarantee?
Working without this guarantee is a criminal offence, punishable by imprisonment and a fine, and exposes the company to paying for all repairs itself in the event of a claim, as well as difficulties winning future contracts.
How much does a ten-year guarantee cost?
The premium depends on the trade, turnover, how long the company has been established, and its claims history. A personalised quote is needed for a reliable price.
When does the ten-year guarantee take effect?
It takes effect from the date the work is formally accepted ("réception des travaux", Article 1792-4-1 of the French Civil Code), not from the date the contract was signed or work began. It covers damage appearing during the 10 years following that completion date.
Does the ten-year guarantee transfer if the property is resold?
Yes. The guarantee is attached to the building itself and benefits whoever owns it at the time a claim arises: it therefore transfers automatically to successive owners for the 10 years following completion, with no formalities required.
Is renovation work covered by the ten-year guarantee?
Yes, as long as it affects structural elements (structure, roofing, foundations) or fixed equipment inseparable from the building, and the defect compromises the building's soundness or makes it unfit for use. Purely cosmetic work or easily removable equipment is not covered.
